1. About this policy
This Acceptable Use Policy (Policy) governs how you may use the SparkyMate application and related services (the App), including the national chat, group chats, private messages, job folders and the Sparky AI feature. It is incorporated into and forms part of our Terms and Conditions. Words defined in the Terms and Conditions have the same meaning here.
The App is operated by SparkyMate Australia Pty Ltd, ACN 699 510 426 (we, us, our). We have zero tolerance for objectionable content and abusive users. If you breach this Policy, we may take the actions set out in section 9.
2. Eligibility
- You must be at least 18 years old to create an account or use the App.
- You must not allow anyone under 18 to use your account.
- You are responsible for all activity that occurs under your account, and you must keep your login credentials secure.
- Each account is for a single named individual. You must not share an account across a business or multiple people, except where a paid plan expressly permits additional named users.
- You must not create another account to get around a suspension, ban or block, or create extra accounts to get around the limits of a free account.
3. General rules
When using the App, you must not:
- Break any applicable law or use the App to help anyone else break the law.
- Interfere with, disrupt, overload, or attempt to gain unauthorised access to the App, its servers, or its infrastructure.
- Introduce malware, or attempt to probe, scan, or test the vulnerability of the App or any system connected to it.
- Impersonate any person or organisation, or misrepresent your identity, trade qualifications, or licensing.
- Use the App to send spam, chain messages, or unsolicited advertising.
4. Content standards (all chats, photos and shared content)
These standards apply to everything you post, send, or share in the App, including messages, photos and reactions in the national chat, group chats and private messages, your username and profile photo, group chat names and photos, and job folders you share. You are solely responsible for your content. You must not post, send, or share content that:
- Is unlawful, defamatory, deceptive, threatening, abusive, harassing, or hateful.
- Discloses another person’s private or identifying information without their consent.
- Includes photos that identify other people, your clients or their premises (for example faces, names, street numbers or documents) where you do not have their consent.
- Is sexually explicit, or promotes violence, self-harm, or illegal activity.
- Infringes anyone’s intellectual property or reproduces copyrighted material (including standards documents or photos of their pages) without the right to do so.
- Presents dangerous or non-compliant electrical practices as safe or encourages unlicensed or unsafe electrical work.
- Is commercial solicitation or advertising, unless we have expressly permitted it.
5. Private messages, group chats and invite links
When using private messages and group chats, you must not:
- Keep sending message requests or messages to someone who has declined your request, blocked you or asked you to stop.
- Use another account or a group chat to contact someone who has blocked you.
- Post a group chat invite link publicly, or use invite links to add people to a chat for spam or harassment.
- Share a job folder, photo or other content with a group chat if you are not allowed to share it.
If you create a group chat, you are its admin. Admins can remove members and manage invite links, and must use those tools responsibly. Anyone who has an invite link may be able to join, so only share it with people you want in the chat.
6. The Sparky AI feature
When you use Sparky AI, you acknowledge and agree that:
- Sparky AI provides general information and guidance only. It is not professional advice and is not a substitute for the on-site judgement of a licensed electrician.
- You must not rely on Sparky AI output as confirmation that any electrical work is safe, compliant, or lawful. You remain responsible for compliance with the AS/NZS wiring rules and all applicable laws, licensing requirements, and site conditions.
- AI-generated output can be incomplete or wrong. You must independently verify anything you act on.
- You must not use Sparky AI to generate unlawful, unsafe, or infringing content, or attempt to extract, copy, or reconstruct the underlying model, prompts, or training data.
- You must not attach photos that show other people, your clients’ personal details or pages of any standard, or enter the text of any standard.
- You must not try to get around the daily question limit on a free account (for example, by using several accounts), or use automated means to send questions.
7. Protecting the App and our rights
You must not:
- Copy, scrape, harvest, or systematically extract data or content from the App, whether manually or by automated means (bots, crawlers, scripts).
- Reverse-engineer, decompile, or attempt to derive the source code, models, or underlying structure of the App.
- Use the App, or any output or data from it, to build, train, or improve a competing product or service.
- Resell, sublicense, or commercially exploit the App or its content without our written permission.
8. Reporting, blocking and moderation
- You can report content or a user that breaches this Policy using the in-app report function, available on messages in the national chat, group chats and private messages, and on user profiles.
- You can block another user at any time. Once you block someone, their messages are hidden from you and neither of you can send the other private messages. You can unblock people in the App’s settings.
- We operate reactive moderation: we do not monitor or pre-screen all content, but we review reports and act on them within a reasonable time. When you report content, we keep a copy of it for our review.
- We use a basic automated filter and posting limits in the national chat to stop certain words and spam. The filter will not catch everything, and content that gets past it is not automatically acceptable.
- We may, but are not obliged to, remove content or take other action even without a report.
9. Our rights if you breach this policy
If you breach this Policy, or we reasonably believe you have, we may take any of the following steps, with or without notice, and proportionate to the breach:
- Remove or restrict access to the offending content.
- Issue a warning.
- Suspend or limit your access to some or all features.
- Suspend or terminate your account.
- Report conduct to law enforcement or other authorities where we are required or permitted to do so.

10. Access to private chats
Private messages and group chats are private between participants, and we do not routinely read them. However, you acknowledge that we may access, review, and retain content in private messages, group chats and shared job folders where it is reasonably necessary to:
- Investigate a report or a suspected breach of this Policy.
- Respond to a safety risk or abuse.
- Comply with a law, court order, or lawful request from an authority.

11. Changes to this policy
We may update this Policy from time to time. If we make a material change, we will notify you and, where appropriate, ask you to accept the updated Policy before you continue using the App. Continued use after a change takes effect means you accept the updated Policy.
