Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this policy limits or removes those rights. If our service fails to meet a consumer guarantee, you may be entitled to a remedy such as a refund, and to compensation for any other reasonably foreseeable loss or damage.

Your rights under New Zealand law

If you are a consumer in New Zealand, our services come with guarantees under the Consumer Guarantees Act 1993 (NZ) that cannot be excluded, and the Fair Trading Act 1986 (NZ) also applies to our dealings with you. Nothing in this policy limits or removes those rights. If our service fails to meet a guarantee under that Act, you may be entitled to a remedy, which may include a refund.

Free account and subscriptions

You can use SparkyMate with a free account, which has limited features, for as long as you like. A paid subscription unlocks the full App and renews automatically at the end of each billing period until you cancel. Subscriptions are sold through the Apple App Store and Google Play.

Change of mind

We do not provide refunds for change of mind, including where you have started a subscription and later decide you no longer want it. You can cancel at any time to stop future billing, but amounts already paid for the current billing period are non-refundable. You keep access to your subscription until the end of that period.

Cancelling your subscription

To cancel, go to your subscription settings in the store you subscribed through — on iPhone, Settings → your name → Subscriptions; on Android, the Google Play Store app → your profile → Payments & subscriptions. Cancel at least 24 hours before your renewal date to avoid being charged for the next period. Deleting the App or your SparkyMate account does not cancel your subscription.

Refund requests

Because Apple and Google process subscription payments, refund requests are generally handled by the store under its own refund process. You can request a refund through the store — for Apple, at reportaproblem.apple.com; for Google Play, through your Google Play order history.

If you believe the App has failed to meet a consumer guarantee, you can also contact us at admin@sparkymateaustralia.com.au with your account details and a description of the issue. We aim to respond within 5 business days and will work with you, and with the store where needed, to put things right. Asking the store for a refund does not affect your rights under the Australian Consumer Law or New Zealand law.
