1. About this policy

SparkyMate Australia Pty Ltd, ACN 699 510 426 (“SparkyMate”, “we”, “us”, “our”) provides the SparkyMate mobile application (the “App”), an information, community and job-management tool for electricians and apprentices that includes an AI assistant (“Sparky AI”), national and private chats, trade calculators and job folders. We also operate the website at sparkymateaustralia.com.au (the “Website”). We are committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). If you are in New Zealand, we also aim to handle your personal information consistently with the Privacy Act 2020 (NZ).

This policy explains what personal information we collect through the App and the Website, how we use and disclose it, and how you can access or correct it. By using the App or the Website, you agree to the handling of your information as described here.

2. What information we collect

We may collect the following categories of personal information:

  • Account information — such as your name, email address, and password when you create an account.
  • Profile information — such as your username, profile photo, State or Territory, whether you are a licensed electrician or an apprentice, your apprenticeship start date (which the App uses to show your apprentice year), and your licence number if you choose to provide it.
  • Sparky AI inputs — the questions, text, photos and other content you enter into Sparky AI, and the responses it generates for you.
  • Community content — messages, photos, reactions and replies you post in the national chat, in group chats or in private messages; message requests you send or receive; the group chats you create or join; and messages you save to your library. This content may include personal information about you or other people.
  • Job folder content — job names, notes, photos, descriptions and other records you create in job folders, which may include information about your clients and the sites you work on (see section 7).
  • Safety and moderation information — reports you make or that are made about you (including a copy of the reported content), users you block, and any warnings, suspensions or other action we take on your account.
  • Usage and device information — such as app interactions, log data, device type, operating system, your device’s push-notification token and notification settings, and general analytics.
  • Subscription information — if you buy a subscription through the Apple App Store or Google Play, the store processes your payment. We receive confirmation of your subscription status, plan, and the related transaction and renewal details, but not your card or bank details.
  • Waitlist information — if you join our waitlist on the Website, your email address and any other details you enter in the form.
  • Any other information you choose to provide — for example when you contact our support team.

3. How we collect it

We collect personal information directly from you when you create an account, set up your profile, use the App, join our waitlist, buy a subscription or contact us. We collect some information automatically through your use of the App and the Website (for example, log and analytics data). We receive subscription information from Apple or Google through our subscription management provider. We may also collect personal information about you from other users — for example, when someone mentions you in a chat, invites you to a group chat, shares a job folder with you or reports content involving you.

4. How we use your information

We use your personal information to:

  • provide, operate and improve the App, including Sparky AI, the chats, calculators and job folders;
  • create and manage your account and profile, and show your username, profile photo and profile tags to other users;
  • work out which features you can use with a free account or a paid subscription, and manage subscriptions;
  • send you push notifications, for example about new messages, replies or message requests (you can turn these off in your device settings);
  • provide customer support and respond to your enquiries;
  • maintain the security and integrity of the App, moderate content, respond to reports and prevent misuse;
  • tell you about the App’s launch and updates if you joined our waitlist or have agreed to hear from us (you can unsubscribe at any time);
  • comply with our legal obligations.

We use a basic automated filter that stops certain words from being posted in the national chat, and limits on how often messages can be posted there. Apart from that, we do not use your personal information to make decisions by automated means that significantly affect your rights or interests.

5. Sparky AI and your inputs

Sparky AI is powered by a third-party artificial intelligence provider, Anthropic. When you enter a question, photo or other content into Sparky AI, that content (together with earlier messages in the same conversation, so Sparky AI can follow it) is sent through our servers to our AI provider and processed to generate a response. Our AI provider is located overseas (including in the United States).

We store your Sparky AI conversations, including any photos you attach, with your account so the App can show them to you. They are deleted if you delete your account (see section 11).

You should not enter sensitive personal information, confidential information, or the text of copyrighted materials (including Australian Standards) into Sparky AI. Before attaching a photo, check that it does not show people’s faces, client names or addresses, documents, or pages of a Standard. Information you enter may be transmitted overseas as described in section 9.

Under our AI provider’s commercial terms, your inputs and outputs are not used to train its models by default. We will notify you if this position or this policy changes.

6. Chats, message requests and private messages

The App includes a national chat, group chats and private messages between users. We collect and store the messages, photos and other content you post or send in these features so that we can provide them.

Who can see your content. Content you post in the national chat is visible to all other users of the App. Content you post in a group chat is visible to its members, which may include people who join later. Your username, profile photo, and your State and licence or apprentice tag are shown next to your messages. Do not share personal or sensitive information in any chat that you would not want others to see.

Read receipts and typing indicators. In group chats you belong to and in private messages you have accepted, other participants can see when you are typing and when you have read their messages (for example, in a “seen by” list). Read receipts cannot currently be switched off. These indicators are not shown in the national chat.

Message requests and blocking. Other users can send you a message request. You can decline or block any request, and accept it if you have a paid subscription. If you block someone, their messages are hidden from you and neither of you can send the other private messages. We do not tell a user that you have blocked them.

Our access. Private messages and group chats are private between participants, and we do not routinely read them. However, we may access, review and retain chat content (including private chat content) where it is reasonably necessary to: investigate a report or a suspected breach of our Acceptable Use Policy; respond to a safety risk or abuse; or comply with a law, court order, or lawful request from an authority. When content is reported, we keep a copy of it with the report so we can review it even if it is later deleted.

Chat content is stored, disclosed and protected as described in sections 8 to 11.

7. Job folders and information about your clients

Job folders let you keep notes, photos and other records for your jobs, and share a folder with a private group chat. Job folder content may include personal information about other people, such as your clients’ names, addresses and phone numbers, or photos of their premises.

If you add information about other people to a job folder, you are responsible for making sure you are allowed to collect it and use it this way, and for handling it in line with any privacy obligations that apply to you or your business. We store and process it only to provide the App to you and the people you share it with, and we handle it in line with this policy.

When you share a job folder with a group chat, its members can view it. Only share job folders with people who need to see them.

8. Disclosure to third parties

We do not sell your personal information. We may disclose it to:

  • our service providers — including our cloud hosting and database provider (Supabase), our AI provider (Anthropic), our analytics provider (PostHog), our subscription management provider (RevenueCat), our push-notification service (Expo), our website host (Netlify), our business email provider (Microsoft) and the providers we use to store secure backups;
  • Apple and Google, where you buy a subscription through their app stores or receive push notifications through their notification services;
  • other users of the App, to the extent you share content with them or it is visible to them as described in sections 6 and 7;
  • professional advisers, such as our lawyers, accountants and insurers;
  • law enforcement or regulators where required or authorised by law;
  • a purchaser in connection with a sale or restructure of our business.

9. Overseas disclosure

Our main database and file storage are hosted by Supabase in its Sydney, Australia region. Some of our service providers store or process personal information outside Australia. Content you enter into Sparky AI is processed by our AI provider overseas (including in the United States). Our analytics, subscription management, push-notification, website hosting, email and backup providers, and Apple and Google, may store or process information in other countries, including the United States, and Supabase may access or process data from outside Australia to provide its services. Before disclosing personal information overseas, we take reasonable steps to ensure it is handled consistently with the APPs, but overseas recipients may be subject to different laws.

10. Data security, storage and retention

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure, including access controls, multi-factor authentication on our business systems and encrypted connections. No system is completely secure, and we cannot guarantee absolute security.

If a data breach is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.

So that parts of the App work without a connection, some information (such as recent chats, calculator entries and job details) may be stored on your device. It is removed when you delete the App from your device.

We retain personal information for as long as needed to provide the App and to meet our legal obligations, after which we take reasonable steps to delete or de-identify it. Our backups are kept for a limited period (currently up to about 30 days), so deleted information may remain in a backup until that backup is overwritten.

11. Deleting your account

You can delete your account at any time in the App’s settings. When you do, we delete your account and profile details, profile photo, Sparky AI conversations and photos, job folders, saved messages, group memberships and notification tokens, and any photos you sent in chats. Text messages you sent in chats stay in those conversations so they still make sense to the other people in them, but they are shown as from “Deleted user” and are no longer linked to you. Information in backups is removed as the backups are overwritten (see section 10). We may keep limited information where we need it to comply with the law, resolve a dispute or deal with a report — for example, a record that the account was deleted, or content attached to an open report.

Deleting your account does not cancel a subscription bought through the Apple App Store or Google Play. You need to cancel it in your app store account settings.

12. Accessing and correcting your information

You can update some of your profile information in the App at any time. You may also request access to, or correction of, the personal information we hold about you by contacting us using the details below. We will respond within a reasonable period, usually within 30 days. If we decline a request, we will explain why.

13. Complaints

If you have a privacy concern or complaint, please contact us first using the details below. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au. If you are in New Zealand, you may instead contact the Office of the Privacy Commissioner (NZ) at privacy.org.nz.

14. Children

The App is intended for use by electricians and apprentices and is not directed at children under the age of 18 years old. We do not knowingly collect personal information from children.

15. Changes to this policy

We may update this policy from time to time. We will publish the current version in the App and update the date below. Material changes will be notified to you where required.
